Artificial intelligence and judicial proceedings: opportunities and limits under Article 24 of the Spanish Constitution

This research examines the impact of artificial intelligence on the Spanish judicial
process in light of Article 24 of the Spanish Constitution, which enshrines the fundamental right
to effective judicial protection. It explores both the opportunities that AI brings for improving
efficiency, access to justice and legal coherence, and the risks it
poses regarding transparency, procedural equality, reasoning of judicial decisions and judicial
independence.
Based on a comparative analysis within the European Union and the emerging
regulatory framework, particularly the Artificial Intelligence Act, the study concludes that AI
and judicial guarantees can be compatible as long as technology is implemented under
principles of legal safeguard, human oversight and institutional accountability
