Abstract

En el presente trabajo se reseña el proceso de constitucionalización del Derecho de Familia desde la ratificación de la Convención sobre la eliminación de todas las formas de discriminación contra la mujer (CEDAW) en el año 1984 hasta la fecha. Se detallan las declaraciones de inconstitucionalidad y las interpretaciones dadas por el Tribunal Constitucional a varios artículos del Código de Familia como los procesos de adecuación de la normativa familiar realizados en cumplimiento de los compromisos asumidos con la incorporación de los instrumentos internacionales que se analizan al ‘boque de constitucionalidad”
