La inconvencionalidad por omisión apareja el incumplimiento del bloque de convencionalidad -regional o universal- en lo relativo a una cláusula o norma programática que requiere para su efectividad, precisamente por ello, de políticas legislativas o reglamentarias de los Estados signatarios para que aquella se haga efectiva; su acreditación configura, en sí misma, una vulneración al corpus iuris interamericano o universal.
