Abstract
This essay argues that an absolute prohibition to participation in political
activities applies to all officials of the Costa Rican Ombudsman´s Office, contrary to the
majority thesis of the Supreme Electoral Court that advocates the existence of an
intermediate regime for them. Moreover, this paper presents other considerations on the use
of social media for all public officials with an absolute prohibition of political participation.
This analysis restates the position of the dissenting vote of electoral magistrate Luis Diego
Brenes Villalobos to the TSE Resolution N.° 8080-E8-2017.
