Towards an abolition of the child protection system in Spain? Structural limitations of residential care

Abstract

This paper aims to critically analyze the child and adolescent protection system in Spain, with particular attention to the predominant use of residential care as an intervention measure. It begins with the observation that, despite its formally protective nature, this measure is controversial in the scientific literature due to the consequences of separating children from their families of origin. The research adopts a theoretical reflective
methodology, based on reviewing and engaging with academic contributions and established abolitionist theses in international contexts. It also considers structural factors such as the economic and social vulnerability of the affected families, the strain on available resources, and the limited quality of socio-educational intervention. From an intersectional and decolonial perspective, the study examines the implications of these dynamics for the reproduction of inequalities and the potential for the development of institutional abuse practices. The main conclusion is that there is a need to thoroughly review the structures of the protection system, incorporating abolitionist approaches that prioritize strengthening families and reducing the use of residential care as the predominant measure of state intervention.

Master's degree in Social and Educational Interventions from the University of Barcelona. Diploma in Social Education from the University of Barcelona. Professor, lecturer, and researcher in the Department of Applied Pedagogy at the Autonomous University of Barcelona. He has actively participated in the Research Group on Childhood and Adolescence at Social Risk (IARS) and currently collaborates with the Research Collective on Vocational Training (CIFO). In his professional practice, he has worked extensively in the juvenile justice system, including as an educator in the Educators Service of the Provincial Prosecutor's Office of Barcelona and in the Open Environment Team. In the field of child protection, he has worked as a social educator at a Residential Educational  Action Center of the Directorate General for Child and Adolescent Care (DGAIA). He also managed housing programs for young people leaving the guardianship system of the Government of Catalonia, through the Area of ​​Support for Young People in and Leaving Guardianship of the Government of Catalonia (ASTEJ). His main lines of research are child and adolescent protection, juvenile justice, youth violence, and teaching and learning processes for young people in foster care and other vulnerable environments. He also focuses on the evaluation of community programs and projects supporting children and adolescents at risk of social exclusion.
